VerifyNow ("we", "our", "us") is a product of Mick Graphics and Web Design, a business certified and licensed in Kenya. This Privacy Policy explains what data we collect, how we use it, how we share it, and your rights as a user of the VerifyNow mobile app and related services (collectively, the "Service"). By using VerifyNow, you agree to the terms of this Policy.
VerifyNow is intended for legitimate use cases including developers testing applications, individuals protecting their privacy, and professionals managing multiple accounts for business purposes. Use of this service for fraud, spam, account hijacking, or any illegal activity is strictly prohibited and will result in immediate account termination. We actively cooperate with law enforcement and platform abuse teams when violations are reported.
1. Information We Collect
1.1 Information You Provide Directly
- Email address — used for account authentication, transactional emails, and marketing communications.
- Purchase history — credit packages bought, amounts, and timestamps.
- Activation history — virtual numbers requested, target services, countries, and SMS codes received.
- Support communications — any messages you send to us, including their contents and attachments.
1.2 Information Collected Automatically
When you use the Service, we or our Partners may automatically collect:
- Device and usage data — app version, operating system, device type, and platform.
- Log data — IP address, access times, pages or screens viewed, and referring URLs (when accessing our web interface or app).
- Crash reports and diagnostics — error logs and performance data used to improve the Service.
1.3 Information from Third Parties
We may receive limited information about you from our Partners:
- Polar — confirms payment status and the credit amount purchased. We do not receive your full card details.
- Clerk — confirms your authenticated identity so we can associate actions with your account.
2. How We Use Your Information
- To provide, operate, and maintain the VerifyNow Service.
- To process payments and manage your credit balance.
- To send transactional emails (receipts, activation confirmations, account notices).
- Marketing: By creating an account, you agree that your email address may be used for marketing communications including product updates, promotions, and newsletters. You may opt out at any time by emailing info@mick.co.ke with "Unsubscribe" in the subject line.
- To analyze usage trends and improve app performance and reliability.
- To enforce our Terms of Use and detect fraud or abuse.
- To comply with applicable laws and respond to lawful requests from authorities.
2.1 Fraud Prevention and Abuse Monitoring
To protect the Service, our Partners, and other users, we use automated systems to monitor account activity for patterns consistent with spam, fraud, or abuse — including, for example, a high rate of cancelled activations with no SMS received, or repeated rapid requests across many countries or services in a short period.
- First detection: if your account is flagged for the first time, we'll email you to explain the pattern we observed. Your account is placed under closer review with a reduced daily limit on new numbers and a longer minimum wait before a cancelled activation is refunded. Your existing credit balance is unaffected.
- Repeat detection: if the same pattern is detected again while your account is under review, it will be permanently restricted from requesting new numbers, and any remaining credit balance is forfeited and non-refundable, as described in our Terms of Use.
- If your account is under review and the pattern is not detected again, the temporary limits are lifted automatically and normal limits resume.
- If you believe a restriction was applied in error, you may contact us at info@mick.co.ke. We review such requests, but a restriction may remain in place following review at our discretion.
- Accounts found to be engaged in fraud, spam, or other violations of our Terms of Use may be permanently suspended or terminated, with any remaining credit balance forfeited as described in our Terms of Use.
3. Third-Party Services
SMSConfirmed
VerifyNow uses SMSConfirmed (smsconfirmed.com) to provision virtual phone numbers and deliver SMS codes. When you request a number, your chosen service and country preference are transmitted to SMSConfirmed. We do not share your personal identifiers with SMSConfirmed. SMS codes received are displayed to you and stored in your activation history. VerifyNow acts as a reseller of SMSConfirmed services and is not liable for number unavailability, SMS delivery failures, or service changes by SMSConfirmed. Polar (Payments)
Payments are processed by Polar (polar.sh). When you purchase credits, you interact with Polar's secure checkout. Polar collects your billing name, email, and payment details directly. VerifyNow receives only a confirmation of payment and the credit amount purchased. We do not store your card details. Polar's privacy policy governs the handling of your payment data.
Clerk (Authentication)
Account creation and sign-in are powered by Clerk (clerk.com). Clerk securely stores your email address and manages authentication tokens. VerifyNow does not store passwords. Clerk's privacy policy governs the handling of your authentication data.
4. Sharing and Disclosure of Information
We do not sell your personal information. We may share your information in the following circumstances:
- Service Providers (Partners): We share limited data with SMSConfirmed, Polar, and Clerk solely to operate the Service. These Partners are bound by their own privacy policies and may not use your data for independent purposes.
- Legal Obligations: We may disclose your information to government authorities, law enforcement, or other third parties when required by applicable law, subpoena, court order, or where we believe in good faith that disclosure is necessary to protect rights, property, or safety.
- Business Transfers: If we undergo a merger, acquisition, or asset sale, your information may be transferred as part of that transaction. We will notify you before your data becomes subject to a materially different privacy policy.
- With Your Consent: We may share your information in other ways if you specifically direct or consent to such sharing.
5. Legal Bases for Processing (GDPR Notice)
If you are located in the European Economic Area (EEA) or the United Kingdom, we process your personal data only where we have a valid legal basis, including:
- Contractual Necessity: Processing required to provide the Service you have signed up for (e.g., account management, activations, payment processing).
- Consent: Where you have given clear consent for a specific purpose, such as marketing communications. You may withdraw consent at any time.
- Legal Obligation: Where processing is necessary to comply with applicable law or lawful requests from authorities.
- Legitimate Interests: Where we have a legitimate business interest (e.g., fraud prevention, service improvement) that does not override your fundamental rights and freedoms.
6. Cookies and Tracking Technologies
- Session Cookies: Clerk uses session cookies to maintain your authenticated state while you use the Service. These are essential for the app to function.
- Disabling Cookies: You can manage or disable cookies through your browser settings. Disabling essential cookies may prevent you from signing in or using parts of the Service.
7. International Data Transfers
Your information may be transferred to and processed in countries other than your own, including the United States (Clerk, Polar) and other jurisdictions where our Partners operate. These countries may have different data protection laws than your jurisdiction. Where required, we rely on appropriate safeguards (such as standard contractual clauses or equivalent mechanisms) to protect your data during such transfers.
8. Data Retention
We retain your account and transaction data for as long as your account is active and for up to 3 years thereafter for legal, accounting, and compliance purposes. Activation history (including received SMS codes) is retained for the same period. You may request deletion of your account and associated data by emailing info@mick.co.ke. Note that we may retain certain records where required by law or for fraud prevention purposes even after account deletion.
9. Data Security
All data is transmitted over HTTPS. Authentication tokens are stored securely on your device using the platform keychain. We implement reasonable administrative, technical, and physical safeguards to protect your personal data. However, no electronic transmission or storage system can be guaranteed to be 100% secure. We cannot warrant absolute security of any information you transmit to us. We do not sell your personal data to third parties.
10. Children's Privacy
VerifyNow is not directed at individuals under 18. We do not knowingly collect personal information from minors. If we learn that a user under 18 has provided us with personal information, we will delete it promptly. If you believe a minor has used our Service, please contact us at info@mick.co.ke.
11. Your Rights
You have the right to access, correct, or delete your personal data. To exercise any of these rights, contact us at info@mick.co.ke. We will respond within 30 days.
12. GDPR, UK GDPR & CCPA Rights
If you are located in the European Economic Area (EEA), United Kingdom, or California, you may have additional rights under GDPR, UK GDPR, or the CCPA, including:
- Right of Access — to confirm whether we process your data and to request a copy.
- Right to Rectification — to correct inaccurate or incomplete personal data.
- Right to Erasure — to request deletion of your personal data in certain circumstances.
- Right to Restrict Processing — to request that we limit how we use your data in certain cases.
- Right to Data Portability — to receive your data in a machine-readable format and transfer it to another controller.
- Right to Object — to object to processing based on legitimate interests or for direct marketing purposes.
- Right to Opt Out of Sale (CCPA) — we do not sell personal information.

13. Kenya Data Protection Act, 2019
VerifyNow is operated by Mick Graphics and Web Design, a business based in Kenya. Our processing of your personal data is therefore also governed by the Data Protection Act, 2019 (Kenya) and its regulations, in addition to the rights described elsewhere in this Policy.
Under the Act, you have the right to:
- Be informed of the use to which your personal data is to be put.
- Access your personal data held by us.
- Object to the processing of all or part of your personal data.
- Request correction of false or misleading data about you.
- Request deletion of false or misleading data about you.
The Act establishes the Office of the Data Protection Commissioner (ODPC) as Kenya's supervisory authority for data protection. If you believe your rights under the Act have been violated, you may lodge a complaint with the ODPC (odpc.go.ke) in addition to contacting us directly at info@mick.co.ke.
Where we transfer your personal data outside Kenya (for example, to Partners operating in the United States, as described in Section 7), we do so only where the receiving country has adequate data protection safeguards, where you have consented to the transfer, or where the transfer is necessary for the performance of a contract with you, consistent with Section 48 of the Act. We review our registration obligations as a data controller and/or data processor under the Act on an ongoing basis and will register with the ODPC if and as required.
14. Changes to This Policy
We may update this Privacy Policy from time to time by posting a revised version on our website and in the app. The "Last updated" date at the top of this page reflects the most recent revision. For material changes, we will notify you by email (if you have provided one) or by posting a prominent notice. Continued use of the Service after changes are posted constitutes your acceptance of the updated Policy.
